Foundation Health Therapy LLC

1. Acceptance of Terms
By accessing or using the Services offered by Foundation Health Therapy LLC ("FHT," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Services.
2. Description of Services
Foundation Health Therapy provides a telehealth platform connecting patients with licensed healthcare providers for peptide therapy, hormone optimization, and related wellness services. The Services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 immediately.
3. Eligibility
You must be at least 18 years of age, a resident of a state where FHT operates, and legally capable of entering into a binding agreement. By using the Services, you represent that you meet these requirements.
4. Patient Relationship
Foundation Health Therapy LLC is a Florida limited liability company that provides management and administrative services. Clinical services are delivered by licensed, independent healthcare providers through the platform. A provider-patient relationship is formed only upon a licensed provider's acceptance of your case. FHT does not practice medicine and is not a medical group.
5. Prescription Services
Prescriptions, if any, are issued solely at the discretion of your assigned licensed provider based on clinical evaluation. FHT does not guarantee that a prescription will be issued. Controlled substances are not prescribed through this platform. Compounded medications are prepared by licensed third-party pharmacies; FHT does not compound, dispense, or ship medications directly.
6. Telehealth Consent
By using the Services, you consent to the delivery of healthcare services via telehealth, including video, audio, and asynchronous communication. You acknowledge that telehealth has limitations compared to in-person care and that your provider may determine that an in-person visit is necessary.
7. Payment Terms
Fees are charged via Stripe at the time of service or on a recurring subscription basis as disclosed at enrollment. All fees are in U.S. dollars. Compounded medications that have been shipped are non-refundable. Subscription plans may be cancelled at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial months.
8. Privacy
Your use of the Services is subject to our Privacy Policy and, for protected health information, our HIPAA Notice of Privacy Practices, both available at foundationhealththerapy.com.
9. SMS Communications
By providing your mobile phone number, you consent to receive SMS messages from FHT including appointment reminders, prescription notifications, and care updates. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for assistance.
10. Prohibited Uses
You may not use the Services to: provide false information, attempt to obtain prescriptions under fraudulent pretenses, resell or redistribute medications, violate any applicable law or regulation, or interfere with the operation of the platform.
11. Intellectual Property
All content on the Services, including text, design, software, and trademarks, is owned by or licensed to Foundation Health Therapy LLC. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. FHT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO FHT IN THE THREE MONTHS PRECEDING THE CLAIM. FHT IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
13. Indemnification
You agree to indemnify and hold harmless Foundation Health Therapy LLC, its members, officers, employees, and providers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
15. Dispute Resolution
Any dispute arising from these Terms or your use of the Services shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English in Hillsborough County, Florida. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations.
16. Changes to Terms
We may update these Terms at any time. Material changes will be communicated by email or website notice. Continued use of the Services after changes are posted constitutes acceptance.
